Why Mediation Works

  • Mediation is highly effective for resolving disputes

  • Mediation is quick & cost effective

  • Mediation is a flexible process where you are in control

  • Mediation offers a simple way out of conflict, allowing you to move on

The process of mediation is simple but powerful; it is flexible, allowing the mediator to focus on the needs of both parties. Mediation works because it is a protected and confidential process. Everything discussed is confidential and remains confidential after the mediation. This provides the security needed to discuss and consider possible solutions. Nothing discussed in the mediation is binding unless, and until, both parties decide that they are comfortable with the solution. Unlike court, any solution will be one that you have agreed rather than one that is imposed on you. Therefore mediation often results in creative agreements that benefit both parties.

Mediation can be arranged quickly, unlike a court date which is frequently an 18 month delay. Considerable litigation costs can be saved and the mediation day typically* results in a solution that is acceptable to both parties. Resolution to conflict puts an end to uncertainty and enables all concerned to put the dispute behind them and move forward. There will have been emotional toil, often underestimated or overlooked, and settlement can be a breath of fresh air.
